What do you say to the insurance adjuster after an accident?

An auto accident you didn’t cause is stressful enough, but then comes the cascading calls from insurance adjusters.  You have already given a detailed description to the police officers about how the car wreck occurred.  You also have reported the car wreck to your own insurance company.  So, what could the opposing insurance adjuster possibly want from you?  

The opposing parties’ insurance adjuster immediately goes to work to minimize your injuries and maximize any fault you may or may not have in causing the car wreck.  They are not your friend and they are not there to help you. They are not on your side.

What should you do?

1) Be polite and give them your basic information.

2)Write down their name, phone number, email address and the claim number assigned to your claim.

3)Tell the adjuster where your car is located and give them permission to inspect it.

4)Do not disuss your version of how the accident occurred unless you have the police report in front of you.  Better yet, only give a recorded statement to an adjuster regarding accident details with your attorney present.  The opposing adjuster’s one goal is to blame you for doing something wrong.  They are experts at maximizing your fault, and you may unwittingly fall into their trap.

5)Do not discuss your injuries at this time.  The insurance adjuster will likely be recording your initial contact and you don’t want to say too much or too little, so our advice is to say nothing at all.  You may want to inform the opposing adjuster that you will be receiving medical attention and will have your attorney share that information when appropriate.
